Welcome to Southern Stone Communications’ websites and digital services, including daytonaradio.com and the digital properties associated with: WHOG-FM 95.7 (HD1 & HD2), WYVB-FM 103.3 (HD1 & HD2), WKRO-FM 93.1, WLOV-FM 99.5, and WNDB-AM 1150 (and 93.5 FM) (collectively, the “Services”). These Terms of Use (“Terms”) govern your use of the Services.
By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
1) Who We Are
The Services are operated by Southern Stone Communications (“Southern Stone,” “we,” “us,” “our”).

2) Privacy
Your use of the Services is also subject to our Privacy Policy (posted on daytonaradio.com and/or linked on station sites). Please review it to understand how we collect and use information.
3) Eligibility
You must be able to form a binding contract to use the Services. If you are under 13, do not use the Services. If you are under 18, use the Services only with permission of a parent/guardian.
4) Intellectual Property
All content on the Services—including audio streams, station names/brands, logos, graphics, text, photos, videos, code, and compilations—are owned by or licensed to Southern Stone and are protected by intellectual property laws.
You may view and use the Services for personal, non-commercial use only. You may not copy, reproduce, distribute, modify, create derivative works, publicly display, or exploit any content without our written permission, except where permitted by law.
5) Streaming Audio and Service Availability
We may provide live or on-demand audio streams. Streams may contain ads and may be interrupted, unavailable, or modified at any time. We do not guarantee uninterrupted or error-free service.
6) Your Conduct
You agree not to:
- Use the Services for unlawful purposes
- Attempt to access accounts, systems, or data you are not authorized to access
- Interfere with the Services’ operation or security
- Scrape, harvest, or collect information (including emails/phone numbers) without permission
- Upload or transmit malware, spam, or harmful code
- Impersonate others or misrepresent your affiliation
7) User Submissions
If you submit content (e.g., photos, videos, messages, contest entries, comments) (“User Content”), you represent you have the rights to submit it and it does not violate any law or rights of others.
Unless otherwise stated in official contest rules, you grant Southern Stone a non-exclusive, worldwide, royalty-free, sublicensable license to use, reproduce, modify, adapt, publish, translate, display, distribute, and create derivative works from your User Content in any media in connection with operating, promoting, or improving the Services and our stations.
You understand that User Content may be public and may be shared or reposted by others.
8) Third-Party Links and Services
The Services may link to or integrate third-party services (ticketing, social media, advertisers, embedded players). We are not responsible for third-party content, policies, or practices. Your use of third-party services is at your own risk.
9) Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, SOUTHERN STONE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
10) Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SOUTHERN STONE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICES.
IN ANY EVENT, SOUTHERN STONE’S TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED $100.

11) Indemnification
You agree to defend, indemnify, and hold harmless Southern Stone and its affiliates, officers, employees, contractors, and agents from any claims, liabilities, damages, losses, and expenses (including attorneys’ fees) arising from your use of the Services, your User Content, or your violation of these Terms.
12) Termination
We may suspend or terminate access to the Services at any time for any reason, including if we believe you violated these Terms. Sections that by their nature should survive will survive termination (e.g., IP, disclaimers, limitation of liability, indemnity).
13) Governing Law and Venue
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. You agree that any dispute will be brought in the state or federal courts located in Volusia County, Florida, unless applicable law requires otherwise.
14) Changes to These Terms
We may update these Terms from time to time. Changes are effective when posted with a new “Last Updated” date. Continued use after posting means you accept the updated Terms.
